1. Acceptance of Terms
1.1 Your use of the Consuwecusta website, including any services, content, or data provided through it, is subject to these Terms.
1.2 By accessing or using the service, you agree to be bound by these Terms. If you disagree with any part of these Terms or are not authorized to comply, you must not access or use the service.
2. Disclaimers
2.1 All services provided by the Administrator are offered “as is,” “as available,” and “with all faults.” The Administrator disclaims all warranties, whether express or implied, including but not limited to guarantees of condition, quality, reliability, accuracy, commercial value, or suitability for specific purposes.
2.2 The Administrator does not guarantee the existence, quality, safety, or legality of goods or services published by users on the platform. The Administrator is not responsible for the accuracy of information provided by users in their listings, nor for the ability of buyers to pay or sellers to fulfill transactions. The Administrator is also not liable for the infringement of third-party rights related to goods or services listed on the platform.
2.3 Users are encouraged to request documentation from buyers to confirm compliance with applicable laws and regulations.
2.4 You acknowledge that you are solely responsible for your safety and agree to meet other individuals for transactions only in safe, public places during daylight hours. You are responsible for conducting due diligence on anyone with whom you plan to meet.
3. Account Registration
3.1 To use certain features, you may be required to register an account and provide accurate information as prompted by the registration form.
3.2 You may create an account as an individual or as a representative of a company.
3.3 Only one account per person is allowed. If multiple people access an account from the same device, we may request proof of identity to avoid duplicate accounts.
3.4 You are responsible for maintaining the confidentiality of your account details and for any activity that occurs under your account.
3.5 By registering, you confirm that you are of legal age or are using the service under the supervision of a parent or guardian. Minors must obtain permission from a parent or guardian before using the service.
3.6 The Administrator reserves the right to suspend or terminate your account or restrict your access without notice if:
(a) You violate these Terms,
(b) Suspicious activity is detected, or
(c) There is reason to believe you are engaging in fraudulent or other inappropriate activities.
3.7 You agree to notify the Administrator immediately of any unauthorized use of your account or other security breaches.
4. Service Use
4.1 The Platform allows users to post announcements, view others’ posts, and communicate with other users.
4.2 The Administrator is not a seller, manufacturer, distributor, or service provider for any items listed on the platform. All transactions, including sales and services, are between users.
4.3 Users are responsible for any applicable taxes on their goods or services.
4.4 The Administrator reserves the right to delete or block user posts at any time without notice if required by law, to protect intellectual property rights, or if the content violates these Terms.
4.5 The Administrator is not responsible for user content, including its accuracy or legality, and makes no guarantees regarding its quality. Interactions between users are solely between those users, and the Administrator is not liable for any damages resulting from those interactions.
5. Posting Announcements
5.1 Users must provide any documents requested by the Administrator to confirm the legitimacy of their posts.
5.2 Users posting goods or services must provide accurate, complete information and ensure their contact details are up-to-date. Failure to maintain an accessible phone number may lead to temporary removal of listings.
5.3 Terms and conditions for sales must comply with these Terms and applicable laws.
5.4 Prices for goods and services must be exact, and any changes should be stated in the announcement.
6. User Responsibilities
By using the Platform, you agree:
- To provide accurate and truthful information during registration and throughout your use of the Service.
- To keep your account details updated and notify us of any unauthorized access or use.
- Not to post any false, misleading, or illegal content.
- Not to post content that violates intellectual property rights or personal rights.
- To use the Service in compliance with all laws and not for illegal activities.
7. Indemnity and Limitation of Liability
7.1 The Administrator and its affiliates are not liable for any lost profit, indirect, special, or consequential damages arising from your use of the Service.
7.2 Our liability for any claims is limited to the amount you paid for the Service in the six months prior to the issue arising, or KSH 10,500, whichever is lesser.
8. Intellectual Property Rights
8.1 You retain ownership of any content you submit, but grant the Administrator a non-exclusive, worldwide, irrevocable license to use, display, and distribute it as part of the service.
8.2 If you believe your intellectual property rights have been infringed, you may contact the Administrator with a formal complaint. Your notice must comply with legal requirements, including a description of the infringing material, your contact information, and proof of ownership.
9. Miscellaneous Provisions
9.1 If any provision of these Terms is deemed invalid or unenforceable, the rest will remain in effect.
9.2 The Administrator may transfer its rights and obligations under these Terms to another party.
9.3 If the Administrator fails to act on a breach, it does not waive the right to enforce these Terms in the future.
